Information about the protection and transfer of personal data Brazilian Law No. 13,709/2018

In accordance with Law No. 13,709 of 2018, we inform you about the purposes and methods used, safeguarding privacy and integrity, to process the data collected, stored, monitored, and stored by the Association of Radicais in Brazil, the data controller.

DATA CONTROLLER: The Association of Radicais in Brazil (hereinafter "Radicais in Brazil") headquartered at Rua Antônio do Campo, 72, Casa 7, CEP 04459–000, São Paulo - SP, 04836-020. As the data controller, in accordance with Article 5, VI of the law, this data is processed collectively to specifically meet the purpose established in this statement.

PURPOSE OF PROCESSING: The objectives of collecting and storing Radicais in Brazil data are to maintain the voluntary relationship established by the data subject, promotional or informative contacts regarding projects, institutional activities, and fundraising initiatives, as well as surveys.

DATA SUBJECT RIGHTS: Data subject rights include the right to confirm the existence of processing, the right to access data, the right to rectify, anonymize, block, or delete data, the right to portability, the right to be informed about automated decision-making processes concerning individuals, and other rights as established by the law (Article 18 of Law 13,709).

DATA RETENTION PERIOD: Data will be stored in our records for the necessary period to maintain the established relationship with the data subject and inform them about the mentioned purposes or for administrative-accounting reasons, allowing Radicais in Brazil to legitimately carry out its institutional activities until the interested party reports the loss of interest in our mission or, in any case, for up to 15 years from the date of the last active relationship with Radicais in Brazil. Only photos and videos will be stored and processed until consent is revoked for historical documentation purposes.

To inform Radicais in Brazil of a subsequent lack of interest, sending an email to jordelio@radicaisnobrasil.org.br will suffice. In this case, Radicais in Brazil will take appropriate technical and organizational measures to cease contact with the data subject. Subsequently, data will be anonymized for statistical purposes and then destroyed, unless otherwise provided by legal retention obligations, supervisory authorities, law enforcement agencies, or the judiciary.

The data subject can revoke consent at any time, without prejudice to the legality of processing based on consent given before revocation, and has the right to lodge a complaint with the supervisory authority. Once the interest in personal data deletion from the database is expressed, Radicais in Brazil will have up to 30 days to proceed with the said deletion, during which photos for which consent had been previously granted may be published without the right to any compensation to the data subject.

LEGAL BASIS FOR PROCESSING: Processing is carried out based on "legitimate interest" (Article 10) in keeping the relationship voluntarily established by the person with Radicais in Brazil active and being informed about the activities, projects, or awareness actions of Radicais in Brazil for as long as necessary, as specified in item 10 of this statement. Furthermore, data will be processed to comply with administrative and other mandatory rules according to current legislation.

PROCESSING TOOLS: All the activities mentioned above can be carried out by controllers through traditional communication tools (e.g., telephone calls, publications, and mail) and computerized electronic tools (e.g., SMS, email, newsletters, direct email marketing, WhatsApp), as well as statistical analysis tools for performance in all phases related to communication, donation, and instrumental activities (e.g., payment communications, donation summaries).

PROCESSING LOCATION: Data processing by Radicais in Brazil will preferably take place in Brazil. Processing may also occur at other Radicais in Brazil offices worldwide, as per the data sharing agreement and in accordance with Article 5, XVI of the law. An updated list of processing locations is always available on the website radicaisnobrasil.org.br.

INFORMATION PERSONALIZATION: Data will be processed to contact the data subject for the described purposes. Contacts can also be made in a personalized manner, considering the characteristics of behavior and interests shown (e.g., events attended, residence, donation amount, donation frequency). This will lead to the selection of stored information related to the individual, so they receive only communications of interest, aligned, and more suitable to their preferences.

PHOTO AND VIDEO: Photographs and videos taken during events promoted by Radicais in Brazil may be preserved by Radicais in Brazil for historical documentation purposes and used through printed publications (magazines, brochures, newsletters, etc.), as well as websites and social media, exclusively for promotional purposes and to highlight and publicize activities carried out. Preservation and use may occur both in Brazil and in offices worldwide.

AUTHORIZED PERSONS FOR PROCESSING: Data may be processed by the following persons who receive appropriate operational instructions: a) operators managing relationships with sympathizers, friends, collaborators, actual and potential donors, and those who contact Radicais in Brazil (Fundraising); b) those responsible for administration, institutional, and statutory activities; c) call center operators, web services, information systems, and data security; d) third parties, data controllers, for instrumental purposes related to activities promoted by controllers, communication, donation, and administration; e) administrative and judicial authorities and agencies due to legal obligations.

The controllers will always have an updated list of data processing personnel available to the data subject.

SPOUSE DATA: Those providing their spouse's data must first ensure that they have been properly informed and have consented to the processing of their data by us as described in this statement and have been informed of the right to withdraw consent.

PUBLICATION OF INFORMATION ON THE WEBSITE: An updated copy of this information will always be available on the Radicais in Brazil website, www.radicaisnobrasil.org.br
